Waltham Forest, London
Planning appeals in Waltham Forest
Waltham Forest grants 81.5 per cent of householder applications, so a refusal is far from unheard of, and it has recently issued new guidance on alterations and retrofit. Both facts matter if you have been refused. A householder appeal must be made within 12 weeks of the decision notice. We read the refusal, test it and prepare the appeal drawings and statement.

How we work on planning appeals
Seven steps from first call to approval.

Enquiry and constraints check
We check the property against conservation areas, listed status, Article 4 directions, tree preservation orders, flood zone and planning history. We choose the right route and send a fixed quote.
Measured survey
We survey the house on one datum: rooms, levels, boundaries, drains, trees and the neighbours' windows that the 45° and 25° tests depend on.
Design options
We model the house in Revit and show you options in 3D and plan, with the planning strategy and the precedents in your street.
Design frozen
You choose an option in writing. Nothing changes after this without your say.
Independent check
A second chartered technologist checks every sheet against the council's validation checklist and the policy. A senior review signs it off before anything is submitted.
Submission
We prepare the forms, certificates, fee and documents and submit through the Planning Portal.
Officer liaison
We answer the planning officer and make any amendments within five working days, at no charge until approval.
Free redraws until approval. Every drawing set is checked independently, and the checker is never the person who drew it.

New guidance and the date of your decision
The council's current documents are the Local Plan Part 1: Shaping the Borough 2020-2035, the Residential Alterations and Retrofit SPD and the Securing Exemplar Design Quality (planning guidance). The retrofit guidance is recent, so the date of your decision notice matters more here than in a borough whose rules have stood still.
Why? An inspector applies the policy in force when the appeal is decided, not necessarily the policy the officer used. If your refusal quoted older design guidance, and the newer document says something different on, say, roof extensions or window replacement, the argument changes. If it went the other way, with the officer relying on a newer rule, we check how much weight a very recent document can properly carry.
There is no council rule for appeals themselves, so we start with the refusal reasons and the guidance each one cites, then read the officer's report to see how the policy was applied to your particular house. Where the report records a site visit, we look at what the officer noted about neighbouring properties, because comparisons with similar houses nearby are among the strongest points an appeal can make.

What the borough's decision figures say
In the latest year the council decided 771 householder applications, granting 81.5 per cent and deciding 90.7 per cent in time. Minor applications ran at 525 decisions, with 76.6 per cent granted and 89 per cent in time.
A refusal here is far from rare, and it should not be read as a personal verdict. These figures describe the council, not the Inspectorate, and they say nothing about how an appeal will turn out. We use them only to judge how routine a refusal is, never as a promise. If your decision came close to the limit, ask whether an extension of time was formally agreed.
Article 4 areas, Green Belt and protected trees
Waltham Forest has 15 Article 4 directions which cover 807 mapped areas, a large footprint compared with the number of directions. Where permitted development has been removed, a project that looked as if it needed no application may have been unauthorised from the start, so check the position before you appeal.
About 22 per cent of the borough is Green Belt. The council also publishes 231 tree preservation orders and 218 tree zones, and a protected tree in a neighbouring garden can govern where a rear extension may stand.
Heritage is lighter: 15 conservation areas and 118 listed entries. Still, we check each against your address. A listed neighbour or a locally listed building next door can matter as much as a designation on your own plot, since the setting of a heritage asset is a planning consideration in its own right.
Timing, and when to revise instead
The Inspectorate's median for householder appeals by written representations was 11.6 weeks in its latest release, and 18 weeks for written representations overall across twelve months. These are national figures.
If the refusal is narrow, a revised planning application in Waltham Forest can be quicker than waiting. If a permitted-development scheme was refused or you doubt your rights, the lawful development certificate service in Waltham Forest is the question to settle first.
What we prepare
We prepare accurate existing and proposed drawings, grounds of appeal tied to each refusal reason, and a concise statement. Before anything goes to the Inspectorate, a second MCIAT chartered technologist checks the set against the notice.
We do not promise a result, because the inspector decides independently. You receive a fixed quote after our free constraints check. Our borough overview is architectural drawings in Waltham Forest, and nearby we cover planning appeals in Redbridge and planning appeals in Hackney.

Questions
Does the new alterations guidance help or hurt my appeal?
It depends on what your refusal cited and when. We compare the refusal with the guidance in force at the time of decision and the time of appeal, and tell you which way it cuts.
How long do I have to appeal in Waltham Forest?
12 weeks from the date on the notice for a householder application. Other appeals have a longer limit set out in the Development Management Procedure Order 2015.
I live near the forest. Is my house Green Belt?
Possibly. We check your address against the published designation, because Green Belt changes the test used for extensions.
Will you tell me if the refusal looks sound?
Yes. If the reasons stand up, we say so and suggest a revised scheme rather than an appeal.
