Planning appeals in Hackney

Planning appeals in Hackney start with the refusal notice. Hackney is a borough of flats, conversions and conservation areas, and a refusal here can turn on heritage or on a restriction that removes permitted development. A householder appeal must be made within 12 weeks of the decision notice. We read the refusal against Hackney's own guidance and prepare the drawings and statement for the appeal.

How we work on planning appeals

Seven steps from first call to approval.

The same model cut through the middle: every floor, the stair, the chimney breasts, the new mansard, rear extension and basement in section
Section through the model: every floor on one datum.
    1. Enquiry and constraints check

We check the property against conservation areas, listed status, Article 4 directions, tree preservation orders, flood zone and planning history. We choose the right route and send a fixed quote.

    2. Measured survey

We survey the house on one datum: rooms, levels, boundaries, drains, trees and the neighbours' windows that the 45° and 25° tests depend on.

    3. Design options

We model the house in Revit and show you options in 3D and plan, with the planning strategy and the precedents in your street.

    4. Design frozen

You choose an option in writing. Nothing changes after this without your say.

    5. Independent check

A second chartered technologist checks every sheet against the council's validation checklist and the policy. A senior review signs it off before anything is submitted.

    6. Submission

We prepare the forms, certificates, fee and documents and submit through the Planning Portal.

    7. Officer liaison

We answer the planning officer and make any amendments within five working days, at no charge until approval.

Free redraws until approval. Every drawing set is checked independently, and the checker is never the person who drew it.

Planning appeals in Hackney: Hackney's applications are mostly not houses

Only 18.8 per cent of Hackney households live in a house, and 24.6 per cent own their home. That shapes the council's caseload: it decided 689 minor applications but only 415 householder ones. The minor category covers flat conversions, mansard additions to converted properties, and small mixed-use schemes, which is where many appeals originate.

Hackney granted 84.6 per cent of householder applications and 81.6 per cent of minor ones, with 91.3 and 87.4 per cent decided in time. Refusal is therefore a minority outcome, and the reasons given are usually particular to the building: roof form, rear infill, window design or loss of garden.

Article 4 directions and why they matter here

The council publishes 77 Article 4 directions, and these remove permitted development rights in defined areas, which can cover changes to windows, roofs and front boundaries. If you were refused for something that would be permitted elsewhere, the direction may be the reason.

That changes how we approach the appeal. The statement cannot argue that the work is permitted development, because the direction has removed the right. It must argue that the proposal is acceptable on its planning merits, with attention to the character of the area that the direction exists to protect. We map the direction boundary against your address first, because a direction that does not cover your property is a straightforward ground.

    Heritage in the borough

Hackney has 37 conservation areas, 555 list entries and 40 entries on the Heritage at Risk Register. Where a refusal quotes harm to a conservation area, the inspector has a statutory duty to pay special attention to its character, and the appeal must engage with that duty.

The council's Residential extensions and alterations SPD and its Retrofit SPD are the documents officers use, alongside the Hackney Local Plan 2033 (LP33). The retrofit guidance is a useful one for appeals: a scheme that improves energy performance in a sensitive way can score points that a plain extension cannot, and we draw the insulation and glazing detail so the inspector sees it.

Mansards, rear infill and the evidence that helps

Many Hackney appeals involve a roof or a rear addition on a terrace that already has a visible pattern of alterations. The strongest evidence is a measured survey of the terrace elevations, marking which neighbours already have a mansard, a rear dormer or a closet wing infill, and which of those carried permission. An inspector can see at once whether the proposal continues an established pattern or breaks it.

Where the pattern is mixed, we draw the proposed profile over the existing and neighbouring roofs on one sheet. Where the terrace is intact, we concentrate on the design quality of the addition: material, set-back, window proportion and the junction with the party wall. A modest, well-detailed scheme is easier to defend than a large one defended with adjectives.

    Options after a refusal

The Planning Inspectorate's median for a written-representations householder appeal was 11.6 weeks, and 31 per cent of section 78 appeals were allowed in the latest quarter. Both are national figures.

For an unlawful or uncertain existing use or alteration, Hackney dealt with 258 lawful development certificate applications, and a Lawful Development Certificate can settle a factual question without an appeal. For flats, a planning consultant can help with the policy case when design alone cannot carry it.

    What our bundle includes

We prepare a statement taking each reason in turn, drawings from a single model, and detailed sections or elevations where the objection is about roof or rear form. Another member of the team reads the bundle before it goes. The fee is fixed after the free constraints check.

For the general method see planning appeals, or for the whole range, architectural drawings in Hackney. We give no assurance about the inspector's decision.

    Leaseholders and freeholders

In a converted building you may need the freeholder's consent as well as planning permission, and a refusal can leave that consent hanging. Before an appeal we ask who owns what, whether the lease allows the work and whether other flats in the building have had similar permissions. Those answers affect the cost-benefit of fighting on, and they often point to a sensible compromise that satisfies both the council and the freeholder.

    Questions

Does an Article 4 direction stop me appealing?

No. It removes permitted development rights, so the appeal is argued on planning merits. Hackney publishes 77 such directions, so we check yours first.

    Is Hackney mostly flats?

Largely. Only 18.8 per cent of households live in a house, which is why minor applications outnumber householder ones in the council's decisions.

How long do I have to appeal?

12 weeks from the decision notice for a householder case.

Which Hackney guidance is most relevant?

The Residential extensions and alterations SPD for extensions, and the Retrofit SPD where energy performance is part of the case.
