Lawful Development Certificate in Enfield: Article 4 and green belt

Two designations decide most Enfield cases. The first is Article 4. Enfield publishes 33 Article 4 direction areas, and each one withdraws a specific right locally. Which right depends on the direction, so we read the direction itself for your street, not a summary of it.

The second is the green belt, which covers 37 per cent of the borough. Householder rights for a dwelling still exist there, but the extra land around a green belt house is often outside its garden, and the curtilage test depends on where the garden really ends. We settle that from the title and the mapping before measuring anything.

Add 24 conservation areas and 301 listed building entries, and the address check is the real first step.

How busy Enfield's certificate desk is

Enfield recorded 636 certificate applications of all kinds in the latest full year of its returns to government. That volume suggests that owners here use the route often, and that officers expect a standard of drawing.

We do not read that figure as a forecast for your case. It tells us the application will be handled in a high-throughput environment, where a clear, complete sheet is the best help you can give the officer.

Outbuildings, garden land and the coverage limit

Domestic gardens made up 21.7 per cent of Enfield's land in the national land-use survey, and they attract garden rooms, studios and sheds. All of them count toward one rule: Buildings (other than the original house) may not cover more than 50% of the curtilage.

We total every building in the curtilage, with its footprint taken from the survey, and show the sum on the block plan. Where the garden is close to the limit already, you learn that before you buy a building. The same total also affects any rear extension added later.

    Rear extensions and two-storey additions

With 61.2 per cent of Enfield households in a house or bungalow, a rear extension is a common request. For a single storey the Order states: 3 m (attached) / 4 m (detached) beyond the original rear wall, single storey.

For anything taller the rule tightens: Over one storey: max 3 m beyond the original rear wall and not within 7 m of the rear boundary. We draw the first-floor line and the distance to the rear boundary on the plan, because those are the two measurements an officer checks first.

On Article 4 land or in a conservation area, ask us before assuming either rule applies; the Order removes some rights on that land, and the direction can remove more.

What an Enfield certificate covers and what it does not

A certificate covers the work shown on the drawings and nothing else. If the design changes after the certificate is issued, for example a deeper extension or a different roof form, the new scheme needs its own application. We therefore fix the design before we submit, and we ask you to review every dimension.

The certificate also does not replace other permissions. Building Regulations still apply to the same work, and a house on Article 4 land may need a planning application for the parts that a direction covers, even when the rest of the project qualifies. We list those separate steps on the quote so nothing is a surprise.

For a garden room or annexe, we also test how it will be used. A building used as extra living space for the house is treated differently from one used as a separate home, and the drawing labels each room accordingly.

Fee, timing and what you receive

The council's fee for a proposed-use certificate is: Half the normal planning fee (householder: £274). You pay Enfield directly, and our fixed fee is £645 including VAT. The statutory period is 8 weeks.

You receive location and block plans plus existing and proposed plans, elevations and sections, checked by a second chartered technologist. If the officer wants amendments, we make them without charging again.

    Questions

What does an Article 4 direction mean for an Enfield certificate?

It withdraws a named permitted development right in a mapped area. Enfield publishes 33 such areas, so we read the direction for your street.

Does the green belt stop me getting a certificate in Enfield?

Not by itself. The green belt covers 37 per cent of the borough, but householder rights for a house can still apply. The curtilage boundary needs checking.

    What is the council fee?

Half the normal planning fee (householder: £274). It is paid to the council.

    How long does Enfield take?

The statutory period is 8 weeks.
