Planning appeals in Sutton
In Sutton a planning appeal can follow two different events: a refusal, or a decision that simply never arrives. The council decided 87.8 per cent of minor applications in time in the latest year, which leaves a visible tail of late ones. A householder appeal has a limit of 12 weeks. We work out which situation you are in, then prepare the drawings and statement.

How we work on planning appeals
Seven steps from first call to approval.

Enquiry and constraints check
We check the property against conservation areas, listed status, Article 4 directions, tree preservation orders, flood zone and planning history. We choose the right route and send a fixed quote.
Measured survey
We survey the house on one datum: rooms, levels, boundaries, drains, trees and the neighbours' windows that the 45° and 25° tests depend on.
Design options
We model the house in Revit and show you options in 3D and plan, with the planning strategy and the precedents in your street.
Design frozen
You choose an option in writing. Nothing changes after this without your say.
Independent check
A second chartered technologist checks every sheet against the council's validation checklist and the policy. A senior review signs it off before anything is submitted.
Submission
We prepare the forms, certificates, fee and documents and submit through the Planning Portal.
Officer liaison
We answer the planning officer and make any amendments within five working days, at no charge until approval.
Free redraws until approval. Every drawing set is checked independently, and the checker is never the person who drew it.

Sutton's own documents and what they mean for an appeal
Sutton publishes no separate rule for appeals, and we say so rather than invent one. The documents a refusal cites are the Sutton Local Plan 2016-2031, adopted in 2,018, and for house alterations the Design of Residential Extensions SPD, with the Urban Design Guide SPD behind it for wider design questions.
The extensions guidance is the one most householder refusals quote. It is a tool for judging scale, position and appearance, not a statute, and an inspector treats it as a material consideration weighed against the plan itself. If the officer treated a guidance figure as a hard limit, that is often the weakest point in the refusal, and we test it against the actual street.
We also check whether any emerging policy is being relied on. Emerging policy carries less weight than the adopted plan, and a refusal that leans on it deserves a closer look, since the officer may have given it more force than an inspector would.

When the problem is delay, not refusal
The council decided 94.8 per cent of householder applications in time, but only 87.8 per cent of minor ones across 196 decisions. Minor applications cover things like a new dwelling on a small plot or a change of use, and they are the category where waits stretch.
If the decision period has expired with no notice, you may appeal against the failure to decide. The limit for non-householder cases is 6 months from the decision notice (or expiry of the decision period). That route is worth weighing, but it hands the decision to an inspector before the council has said what its concerns are, so it is not always the better one.
Often the quicker move is to ask for the officer's current position in writing and agree a short extension in return for specific amendments. We prepare the amended drawings for that conversation, and we tell you when an appeal is the better answer. Keep a dated record of every chase you make to the council, because it shows an inspector how the delay arose and who was waiting on whom.
Grant rates, Green Belt and heritage in Sutton
Of 601 householder decisions in the latest year, 91.8 per cent were granted. Minor applications were granted at 76.5 per cent. The gap between the two shows where risk concentrates: larger, less routine schemes.
About 14 per cent of the borough lies in Green Belt, where extensions are judged against the original house and a refusal for disproportionate additions is common. The borough has only 8 conservation areas, so heritage is a smaller part of the picture here than in inner London, but the 209 listed entries still need checking at address level.
Sutton is an owner-occupier borough, with 64.4 per cent of households owning their home, and 62.9 per cent living in houses. Most appeals we expect here are therefore about houses, extensions and outbuildings rather than flats, and those are the cases where clear, accurate elevations do the most work.
How long the Inspectorate takes
The Planning Inspectorate's latest release shows a median of 11.6 weeks for householder appeals by written representations. For written representations as a whole the twelve-month median was 18 weeks. These are national figures and tell you nothing certain about your own appeal.
If the refusal is narrow, it may be quicker to revise through a new planning application in Sutton. Where the work is already built, read about a retrospective planning application in Sutton before you choose.
What the work involves
We read the notice and report, prepare corrected drawings and write grounds of appeal tied to each reason. A second MCIAT chartered technologist checks the set. We never promise a result, because the inspector is independent, but we will tell you if we think the refusal is sound.

Questions
The council has not decided my Sutton application. Can I appeal?
Yes, once the decision period has run out you can appeal against the failure to decide. Think first about whether agreeing an extension would be quicker.
How long do I have to appeal a Sutton refusal?
12 weeks for a householder application, measured from the date on the decision notice.
Does Green Belt make an appeal weaker?
It changes the test: additions are compared with the original house. A modest, well-drawn scheme can still be allowed, but we say plainly where it looks difficult.
