Retrospective planning applications in Newham
A Newham landlord, buyer or owner who finds an extension, loft or outbuilding without permission can still put it right with a retrospective application. We measure the building as it stands, draw it and make the case to the council. Newham decided 97.2 per cent of householder applications on time in its latest published year. How we work on retrospective planning applications
Seven steps from first call to approval.

Enquiry and constraints check
We check the property against conservation areas, listed status, Article 4 directions, tree preservation orders, flood zone and planning history. We choose the right route and send a fixed quote.
Measured survey
We survey the house on one datum: rooms, levels, boundaries, drains, trees and the neighbours' windows that the 45° and 25° tests depend on.
Design options
We model the house in Revit and show you options in 3D and plan, with the planning strategy and the precedents in your street.
Design frozen
You choose an option in writing. Nothing changes after this without your say.
Independent check
A second chartered technologist checks every sheet against the council's validation checklist and the policy. A senior review signs it off before anything is submitted.
Submission
We prepare the forms, certificates, fee and documents and submit through the Planning Portal.
Officer liaison
We answer the planning officer and make any amendments within five working days, at no charge until approval.
Free redraws until approval. Every drawing set is checked independently, and the checker is never the person who drew it.

What Newham asks of a retrospective planning application
Newham's own householder guide is the Altering and Extending your Home SPD, read alongside the Newham Local Plan 2018, which dates from 2,018. The council has no separate rule for regularising finished work, so an officer tests your extension against the same guide as a new drawing.
That makes the as-built survey the heart of the application. If the guide limits depth, height or the share of garden left over, the officer will measure what is there. Drawings that round a figure in your favour cost credibility at the first site visit.
Where a part of the building falls outside the guide, we say so at the start and price the amendment, because a smaller fix is nearly always cheaper than a refusal and appeal.
We also read the decision notice on any earlier approval at the address. A condition on materials or obscure glazing that was ignored on site is a breach in its own right, and it is better to find it ourselves than to have the officer find it.

Rented homes, sales and the solicitor's questions
Only 30.8 per cent of Newham households own their home, and 47.1 per cent live in a house. So the owner of an unauthorised loft room or rear addition may well be a landlord who inherited it, or a buyer whose solicitor has found works with no consent on record.
A retrospective application, or a certificate of lawfulness where the work is old enough, gives the solicitor a document to attach. Without one, a lender may refuse to proceed or a buyer may ask for a price cut.
The average Newham home sold for £390,349 in the latest Land Registry month. On a sum like that a few weeks spent regularising a breach is cheap beside a collapsed chain.
Council figures that matter to your case
In its latest published year Newham decided 388 householder applications and granted 86.9 per cent. Those cover every kind of home extension, so they show how the borough treats domestic proposals in general and say nothing certain about yours.
The council also handled 281 certificate applications for existing development, a large number. It suggests many Newham owners are asking for proof that old work is lawful rather than applying for permission. We check that route first with our Lawful Development Certificate drawings in Newham.
Where work is too recent to prove lawful, we prepare the application with the borough's planning drawings and, if you need to prove what was built, a measured building survey.
Heritage, HMOs and green belt in Newham
Newham has 9 conservation areas, 125 listed building entries and 21 entries on the Heritage at Risk Register. A changed front elevation or roof in one of those areas is far harder to defend than a rear addition no one sees from the street.
The borough also has an Article 4 direction on houses becoming small HMOs. Rooms added to house more tenants are the classic trigger, so a retrospective application can fail if officers think the building has become an HMO without permission. We tell you plainly if that is the real issue.
A small share of Newham, 2 per cent, is mapped as green belt. If your plot touches it, the openness test is a further hurdle.
Cost, timing and what follows a refusal
The council's fee for a householder application is £548. It has 8 weeks to decide unless you agree longer, and the time limit for enforcement against most unauthorised building works is 10 years.
After a refusal you have 12 weeks to lodge a householder appeal, and our planning appeals service can prepare it. See every service we offer for the borough on our architectural drawings in Newham page, or the neighbouring Tower Hamlets and Redbridge pages.
Before we submit, you receive a short summary of what the officer will see, where we think the case is weakest and what an amendment would cost.

Questions
Can a landlord regularise a loft room built by a previous owner in Newham?
Yes, if the work meets the Altering and Extending your Home SPD and the local plan tests. We survey the room, draw it as built and show the officer what stands. If the work is old enough, a certificate of lawfulness may be the quicker route.
Does the Article 4 direction on HMOs affect a retrospective application?
It can. Newham requires permission to convert a house to a small HMO, so extra bedrooms built for more tenants are examined closely. Tell us how the rooms are used and we advise before you apply.
How long does Newham take to decide?
The statutory period for a householder case is 8 weeks, and Newham decided 97.2 per cent of householder applications in time in its latest published year.
