Lawful Development Certificate in Islington
A Lawful Development Certificate in Islington is the council's written ruling that building work is lawful without planning permission. We are MCIAT chartered architectural technologists and we prepare it from £645 including VAT. In Islington the honest first question is whether you can use one at all: just 16.3 per cent of households live in a house, and flats have no householder rights.

How we work on lawful development certificates
Seven steps from first call to approval.

Enquiry and constraints check
We check the property against conservation areas, listed status, Article 4 directions, tree preservation orders, flood zone and planning history. We choose the right route and send a fixed quote.
Measured survey
We survey the house on one datum: rooms, levels, boundaries, drains, trees and the neighbours' windows that the 45° and 25° tests depend on.
Design options
We model the house in Revit and show you options in 3D and plan, with the planning strategy and the precedents in your street.
Design frozen
You choose an option in writing. Nothing changes after this without your say.
Independent check
A second chartered technologist checks every sheet against the council's validation checklist and the policy. A senior review signs it off before anything is submitted.
Submission
We prepare the forms, certificates, fee and documents and submit through the Planning Portal.
Officer liaison
We answer the planning officer and make any amendments within five working days, at no charge until approval.
Free redraws until approval. Every drawing set is checked independently, and the checker is never the person who drew it.

Lawful Development Certificate in Islington: who can use one
Householder permitted development rights belong to houses. The Order is plain on the point: Householder permitted development (Sch 2 Part 1) does not apply to flats or buildings containing flats. In a borough where 16.3 per cent of households occupy a house or bungalow and 26.7 per cent own their home, most households live in a flat. We tell them so at the first check, before any fee is spent.
The remainder own the Georgian and Victorian terraces that Islington is known for, often as whole houses or as a main house with a lower-ground flat. For those owners a certificate can be valuable, particularly for a rear addition, a loft with a rear dormer or a roof light set, since the allowance is measured from the original building and the evidence is mostly in the brickwork.
A different kind of certificate may suit a flat owner better: one that records an existing use or an older alteration as already lawful. It rests on evidence of time and continuity, not on the Order's limits. If you describe the property's history on the first call, we can say which certificate, if any, fits.

Conservation areas and listed terraces
The borough has 41 conservation areas and 1,050 listed building entries. In a conservation area: On article 2(3) land (conservation areas etc.): no side extensions, no cladding, no rear extension of more than one storey under Class A. Listing is separate again, and listed building consent is not something a certificate supplies.
A terraced house also faces a smaller loft allowance: 40 m³ (terrace house) / 50 m³ (any other house) additional roof volume. A closed rear return, a butterfly roof or a party-wall parapet can complicate how the original volume is read, so we measure those on site and show the working on the sheet.
The council's own guidance matters for the fallback. If a certificate fails, a planning application will be read against the Islington Local Plan: Strategic and Development Management Policies, Site Allocations, and Bunhill and Clerkenwell Area Action Plan, adopted in 2,023, and the Islington Urban Design Guide SPD. Basement ideas fall under the Basement Development SPD, which is outside this service.
Islington's record on householder cases
The borough logged 141 certificate applications in its latest return. Of its householder decisions it granted 92.8 per cent and met the deadline for 98.5 per cent, so a householder application here is a realistic alternative. Where the numbers favour a full application, for example a design that needs to go past the limits, see planning drawings in Islington.
Islington decided 337 householder applications in its published year. Because the volume is modest, a clear set with an explained original footprint is easy for an officer to read in one sitting.
What we draw and what it costs
The set has a location plan, block plan, floor plans, elevations and a section through the part of the building that changes. A second chartered technologist checks every dimension against the Order. We send the set to you first, then submit.
Your council fee is separate: Half the normal planning fee (householder: £274). The statutory period is 8 weeks. If the officer disagrees we review the reasons and advise on a redraw, a householder application or a planning appeal in Islington. We make no promise of a decision, only a clear, checked file.
Photographs do a lot of the work in a terrace. We shoot the rear elevation, the roof slope and the party-wall lines, and mark on them where the original building stops and later additions begin. That marked evidence lets an officer confirm the baseline in minutes, and it protects you if the file is read again years later by a buyer.
Before you commit to a route
A short call with us usually settles the route. If you own a whole house, we proceed with the measured survey. If you own a flat, we ask what you want to change: an internal alteration usually needs no application, unless the building is listed, a roof or rear change needs planning drawings, and an older alteration that has stood for years may qualify for the existing-use route instead.
Whichever applies, the sheets are drawn once and reused. The survey that supports a certificate can carry into building regulations drawings and, where a boundary wall is touched, the party wall notices that Islington terraces so often need.

Questions
Can I get a Lawful Development Certificate for a flat in Islington?
Not for extensions under householder rights, which do not cover flats. A certificate for existing use can still suit some flats; we advise after hearing the history.
Do Islington's conservation areas rule out a certificate?
They narrow it. The borough has 41 areas, and side extensions and cladding are not permitted there.
What is Islington's turnaround for householder cases?
It decided 98.5 per cent of householder cases within time. The certificate period is 8 weeks.
